Twiddy and Company of Duck, Inc. (“Twiddy & Company”, “we”, “us”, or “our”) operates the TwiddyCo mobile applications (the “App”), the www.twiddy.com website (the “Site”). This Privacy Policy applies to personal information we collect through the App, the Site, by email, phone or other offline method, and anywhere else we post this Privacy Policy (collectively, the “Services”).
This Privacy Policy describes the types of information that we may collect or you may provide when you download, install, register with, access, or use the Services. This Privacy Policy also describes our practices for collecting, using, disclosing, and maintaining such information, your rights with regard to your information, and how we protect your information.
This Privacy Policy does not alter the terms of any other agreement that you may have with us. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, DO NOT DOWNLOAD, REGISTER WITH, ACCESS, OR USE THE SERVICES. By downloading, registering with, accessing, or using the Services, you agree to the terms and conditions of this Privacy Policy. This Privacy Policy does not alter the terms of any other agreement that you may have with us.
PERSONAL INFORMATION WE COLLECT. When we use the term “personal information” we mean data that can be used to uniquely identify or contact a unique individual. Personal information does not include publicly available information or deidentified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you. We collect personal information in the following ways: information you choose to provide when interacting with or using the Services, information collected automatically when you interact with the Services, and certain information from third-party sources.
You provide certain information to us when you choose to interact with the Services, including the following:
Registered Users; Account Information. We collect this information for registered users of the Services and for visitors who use the Services, such as to search for real estate properties and vacation rentals, book reservations at a vacation rental, sell a real estate property, or buy a home.
Site. If you register for an account on the Site, we collect your name, email address, street address, phone number, payment information, and any other information you may provide. As a registered user, you can save properties, access upcoming trip information, review your reservations, submit payment information, and sign up for notifications. Through your account dashboard, you can access and update your profile information, change your notification settings, make a payment, and change your password to your account.
If you register for an account on the Site as the owner of a vacation rental property, we collect your name, email address, address of the vacation rental property, phone number, payment information, and any other information you may provide. As the owner of a vacation rental property, you may access reservations, review leases, and view information about your properties.
App. If you register for an account on the App, we collect your name, email address, and password. You have the option to add your address and phone number in your account profile. As a registered user, you can save properties, access upcoming trip information, review your reservations, submit payment information, and sign up for notifications. Through your account dashboard, you can access and update your profile information, change your notification settings, make a payment, and change your password to your account.
If you register for an account on the App as the owner of a vacation rental property, we collect your name, email address, address of the vacation rental property, phone number, payment information, and any other information you may provide. As the owner of a vacation rental property, you may access reservations, review leases, and view information about your properties.
Free Market Analysis. As part of the Services, we may provide you with an estimate of what your home is worth. To provide this service, we collect your name, email address, phone number, street address, details about the property, (e.g., number of bedrooms, number of bathrooms, square footage, type of property, price range, estimated time when you plan to sell) and other comments you provide.
Visitors. Even if you do not use the Services as a registered user to search real estate listings or use other features of the Services, you may still provide us information. We may use links throughout the Services to provide you with the opportunity to contact us via email to ask questions, request information and materials (such as our “Free Market Analysis”), or provide comments and suggestions. You may also be offered the opportunity to have one of our agents or other representatives contact you personally to provide additional information about our Services (e.g. our “Special Events Contact Form” for assistance in planning a Special Event reservation or when requesting information about a particular vacation rental property or to join a waitlist). To do so, we may request additional personal information from you, such as your name, email address, telephone number, event date, and any additional information you may provide to help us respond to your question or fulfill your request.
When you interact with us through various social media platforms, for example, by liking us on Facebook or YouTube or following us on TikTok or Instagram, we may collect information including your email address, location and other demographic information. The information we receive from your social network depends on your privacy settings on those third-party platforms. You should always review, and, if you prefer, adjust your privacy settings on third-party websites and services before linking or connecting them to the Services.
Whenever you visit or interact with the Services, we, as well as our service providers, may use assorted technologies that automatically or passively collect information about how the Services are accessed and used. We refer to this information as “traffic data.” Traffic data may include browser type, device type used to access the Services (i.e., computer or mobile device), unique number assigned to identify such device, operating system, application version, click path taken through the Services, your use of features or applications on the Services, and other usage information. When you use the Services, we collect information about searches and the information you access. This information helps us manage, improve, and customize the Services.
Technologies we use on the Services to collect traffic data, directly or through our service providers, may include cookies (data files placed on your computer or other devices used to access the Services), pixel tags (transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed), embedded scripts, mobile SDKs, location-identifying technologies and logging technologies (collectively, “tracking technologies”). We, or our service providers, may use tracking technologies for security purposes, to facilitate Services navigation, to personalize your experience while visiting the Services, and as otherwise described in this Privacy Policy.
The Site also uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses tracking technologies to help us analyze how users use the Site. The information generated by the tracking technologies about your use of the Site (including your IP address) will be transmitted to and stored by Google. To learn more about Google Analytics and how you can opt out, visit https://tools.google.com/dlpage/gaoptout. By using the Site, you consent to the processing of data about you by Google.
We or our service providers may use information collected through tracking technologies to remarket to you in the future using third-party sites, and our ad partners, based on your past visits to our Site.
You can adjust the tracking technologies used when you visit our Site or the App by adjusting your preferences here: [insert]. If you do disable or opt-out of certain tracking technologies, some features of the Site or App may not work as intended or be available.
We may receive information about you (including personal information) from third parties. For example, if you are on another website and you opt-in to receive information from us, that website will forward to us your email address and other information about you so that we may contact you as requested. We may combine the information we receive from these third parties with information we collect through the Services. In those cases, we will apply this Privacy Policy to any personal information received, unless we have disclosed otherwise.
We or our service providers may receive or infer information about your location from a variety of sources. For example, we may use your IP address to identify your general location or, if you activate the feature on your mobile device, we may receive your precise geolocation data from your mobile device. If you have enabled location information sharing while using the App actively, then your precise location information may be shared with our service provider in order to help you locate vacation rentals or real estate listings near you. We may use location data to analyze certain information, and to improve the App and relevance of the information we provide to you via the App. Please note that if you do not share your location information then we will not be able to send vacation rentals or real estate listings near you and certain features of the App will have limited functionality.
HOW WE USE INFORMATION WE COLLECT. We collect and use your personal information for a variety of business purposes, including to respond to your questions or requests, to provide the Services and the services that you request, to communicate with you about the Services, and to do all things necessary to administer the Services, and manage, protect and improve them. As we mentioned above, we also use the traffic data we collect to improve the Services and to customize your experience.
INFORMATION WE SHARE WITH OTHERS. We may share your personal information and other information we collect with affiliates or business partners that require access to your personal information for business purposes. We may disclose your personal information to third parties to protect the security and integrity of the Services, to correct technical problems and malfunctions on the Services, to technically process your information, to provide the Services or to take precautions against liability. We also may provide your personal information to services provider who provide services on our behalf, such as our payment processor, customer relationship management provider, email delivery provider, third-party website developer, and analytics provider. If you request services via a mobile device, your request will be transmitted via your mobile carrier’s network and your carrier may have access to it. Consult your carrier’s privacy policy for additional information.
We reserve the right to transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business. We reserve the right to disclose any personal information as needed if that information is requested by law enforcement agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity. We also may disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us.
DO-NOT-TRACK REQUESTS; THIRD-PARTY TRACKING. Unless your browser settings are configured to make your online activities and information about your online activities (such as traffic data as described above) invisible to usage analytics tools, we do not presently have the capability to omit you from usage analytics to the extent your browser only sends us a “do not track” message and does not otherwise screen you from tracking without any action on our part.
SECURITY. We use reasonable precautions, including technical, administrative, and physical procedures, to protect personal information from loss, misuse, or alteration. Although guaranteed security does not exist on the Internet or offline, we make commercially reasonable efforts to handle such information consistent with this Privacy Policy and applicable laws. Due to the design of the Internet and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties.
DATA RETENTION. We will retain your personal information for as long as is necessary for purposes for which it was collected. The precise period will depend on the reason why it was collected. Those periods are also based on the requirements of applicable laws, applicable legal and regulatory requirements and periods relating to the commencement of legal actions. Typically, we will keep your information for the period of time that you are a registered user of the Services.
THIRD-PARTY LINKS. The Services may contain links to third-party websites that are not controlled by us. These links are made available to you as a convenience, and you agree to use these links at your own risk. Please be aware that we are not responsible for the privacy practices or content of such third-party websites. This Privacy Policy only applies to information we collect from you while you are on the Services. If you navigate to a third-party website from the Services, we strongly encourage you to review and become familiar with that third-party website’s own privacy policy and statements. Use of third-party social networking websites, such as X, TikTok, Facebook, Instagram and YouTube, are governed by the privacy policies and practices of those websites.
CHILDREN. The Services are not intended for use by children under the age of 13, and we do not knowingly collect personal information from such individuals. If we learn that we have collected the personal information of any such individual, we will take steps to delete the information as soon as possible.
NOTICE TO RESIDENTS OF COUNTRIES OUTSIDE THE UNITED STATES. We are headquartered in the United States and currently our services are only intended for individuals located in the United States. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States. We will protect the privacy and security of personal information according to this Privacy Policy regardless of where it is processed or stored.
YOUR CHOICES. If you need to correct or update your personal information, please use the Site or App to access your account.
Opt-Out: If you receive any promotional e-mail communication from us, you will be given the option to “unsubscribe” from receiving further e-mail communications from us at any time. Your option not to receive promotional and marketing material will not preclude us from corresponding with you, by email or otherwise, regarding your existing or past business relationships with us, and will not preclude us from accessing and viewing your personal information in the course of maintaining and improving the Services.
Cookies: You can set your browser to refuse all or some cookies or alert you when cookies are being sent. If you disable or refuse cookies or block the use of other technologies, some parts of the Services may then be inaccessible or not function properly.
Push Notifications: If you do not want to receive push notifications from us, you may opt out of receiving these when you first launch the App or at a later stage by using the settings on your mobile device.
Location: You can choose whether or not to allow the App to collect and use real-time information about your device’s location through your device’s settings. You can manage these preferences when the App is first launched or at a later stage by using the setting on your mobile device. If you block the use of location information, some functionality on the App will be inaccessible and will not function properly.
ADDITIONAL U.S. STATE PRIVACY DISCLOSURES. The information in this Section 11 may apply to you if you are a resident of California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia. Please contact us using the contact information in Section 13 below if you have any questions about this Privacy Policy, including this section specific to certain residents, or if you would like a printed copy of this Privacy Policy. You may also print a copy of this Privacy Policy by selecting the “Print” option in your web browser.
Shine the Light. Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship what types of personal information, if any, the business shares with third parties for direct marketing purposes by such third parties and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. We do not currently share any personal information with third parties for direct marketing purposes by such parties. How We Collect and Share Personal Information. In the last 12 months, we have collected each of the categories of personal information noted in the table below and disclosed it, for a business purpose, to the categories of recipients listed below. The table also indicates when we sold or shared the personal information to third parties for targeted or cross-contextual advertising in the last 12 months and the types of third parties. For purposes of this Section, when we use the term “third party,” we mean entities that are not service providers or contractors providing services on behalf of Twiddy and that are not entities with whom you interact with directly.

Right to Access (Right to Know Specific Pieces of Information) / Portability. The right to access and obtain a copy of the specific pieces of personal information we have collected about you in a structured, machine-readable format that may be transmitted to another entity without hindrance, to the extent technically feasible.
Right to Correct. The right to request that we correct your inaccurate personal information maintained by us.
Right to Request Deletion. The right to request the deletion or erasure of personal information we have collected from you, subject to certain exceptions.

Right to Revoke Consent. Where we are processing your personal information based on your consent, you have the right to revoke such consent. You may make this request by contacting us at privacypolicy@twiddy.com.
Right to Appeal. In certain circumstances, we may decline a request to exercise the rights described above. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. You may appeal a denied request by contacting us at privacypolicy@twiddy.com.
To exercise your rights to know, access, correct, or delete, please submit a request by filling out our Privacy Rights Request Form or by calling 1-888-457-1520.
We may need to authenticate your identity and request before processing it, which may require us to obtain additional personal information from you. In order to authenticate your identity, we will generally require the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your name, email address, and mailing address in the original request, as well as an explanation of the rights you wish to exercise. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.
If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. Please see the “Authorized Agents” section below for more information.
In certain circumstances, we may decline a request to exercise the rights described above in accordance with applicable law. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. Authorized Agents
In certain circumstances, you are permitted to use an authorized agent to submit privacy rights requests on your behalf. We may verify the authorized agent’s authority to act on your behalf as follows:
For requests to opt-out of personal information “sales” or “sharing,” we may ask you to provide a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.
For all other requests, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Notice, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.
Nondiscrimination
We do not discriminate against you for requesting any of the rights noted above. We are permitted to deny or limit your request in accordance with applicable laws.
Children Under 18
The Platform is not directed to or intended for children under the age of 18. We also do not knowingly collect personal information from children under the age of 18. If you are the parent or guardian of a child and you believe we have inadvertently received personal information about that child, please contact us as described in “Contact Us” below and we will delete the information from our records.
CHANGES TO PRIVACY POLICY.
We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Any updates to this Privacy Policy will be posted on the Services and we will indicate the last updated date of the changes at the top of the Privacy Policy. Your continued use of the Services means you accept those changes as of the last updated date.
